VidCon, LLC is proud to produce VidCon Australia (“Event”). The following Registration Terms and Conditions (“Terms”) apply to you and any party you are registering for participation in any VidCon Event (“Participant”), and such Participant’s registration, attendance, participation, enrollment, and/or application for involvement in the Event, including but not limited to your purchase and/or possession of any Event entry material, such as badges, wristbands, tickets, passes, and giveaways (“Credentials”).

By clicking “I Accept” below and/or by obtaining your Credentials, you agree to these Terms.  If you are registering another party for the Event, you also agree that such party will be bound by these Terms and that you have authority to bind such party in this way.

Terms of Use and Privacy Policy

Each Participant has read, understands, and agrees to the VidCon Terms of Use and VidCon Privacy Policy, which are incorporated herein by this reference.  In the event of a conflict between these Terms and the VidCon Terms of Use, these Terms shall control.

THESE TERMS ARE GOVERNED BY THE DISPUTE RESOLUTION TERMS (AND SUBJECT TO ALL OTHER TERMS) OF THE VIDCON TERMS OF USE, INCLUDING THE ARBITRATION PROVISIONS (SET FORTH IN SECTION 19) AND CLASS ACTION WAIVER (SET FORTH IN SECTION 20) OF THE VIDCON TERMS OF USE. PLEASE READ THE VIDCON TERMS OF USE, AS THEY MAY AFFECT YOUR RIGHTS.

Registration and Attendee Information 

All Event attendees must have purchased a ticket on the VidCon Australia site.  To register for the Event, click here.  All information entered into the registration form must be correct and accurate to the best of your knowledge.

VidCon Credentials are issued to, can be picked up by, and used by only the individual named in the registration. VidCon Credentials are non-transferable after they have been picked up. VidCon badges allow the badge holder entry to specific defined events, but cannot guarantee admission to every VidCon event. Event admission is subject to venue capacity and age restrictions in compliance with state and local laws. Age restrictions are specific to each venue.

To register for the Event, you must be of legal age to form a binding contract, or have obtained your parent or guardian’s permission to register and gotten your parent or guardian to agree to these Terms on your behalf.  Children under the age of 16 must at all times be accompanied by a parent or other adult guardian during the Event. Participants may be required to show proof of age identification to VidCon.

Refund & Revocation Policy

All Credentials are the sole property of VidCon. To the extent permitted by law, VidCon may, in its sole discretion and at any time determined by VidCon, cancel, revoke or refuse from any individual or company the following: Credentials, merchandise, reservations for activities (such as meet & greets and movie nights), and/or other purchases.  VidCon shall not be responsible for any penalty, fee, loss, or expense that might result from such action.

  • You will have until 18 September 2019, at 11:59 PM (AET) to modify your registration.Please refer to our refund policy below.
    • Single-day tickets: Single-day tickets are NONREFUNDABLE.
    • Industry Track ticket: Industry Track tickets are NONREFUNDABLE. Industry Track Student tickets are NONREFUNDABLE.
    • Community, Creator, and Chaperone tickets: Creator Track Student tickets are NONREFUNDABLE. Refunds for Community Track, Creator Track, and Chaperone tickets will incur the following processing fees:
      • A$50 processing fee per ticket refunded between 13 May 2019 and 30 June 2019 at 11:59 PM (AET);
      • A$75 processing fee per ticket refunded between 1 July 2019 and 20 August 2019 at 11:59 PM (AET);

No refunds after 20 August at 11:59 PM (AET).

If you purchased merchandise please make sure you refund your entire order using your order number. If you are unsure whether or not you purchased merchandise, please email australiainfo@vidcon.com.

Unused Credentials have no monetary value and cannot be credited to future years or events. VidCon will not issue refunds or credits due to failure to redeem a discount coupon during the registration process. Discounted prices are based on the date payment is received in the VidCon office.

Lost or stolen Credentials will be subject to a replacement fee.

Use of a Credential by anyone other than the authorized individual will result in revocation of the Credential without any refund.

Communication Regarding the Event

By registering for the Event, you agree to allow VidCon to communicate with you via email with information regarding the event.

Credentials

Badges and/or wristbands may contain NFC or other RFID technologies to help us serve attendees, determine participation in various sessions and activities, and connect you with sponsors or exhibitors.

You must have your Credentials to receive admittance to the Event. If requested by security, attendees may be required to provide additional identification.

Sponsors and Exhibitors

VidCon may have third-party sponsors and exhibitors, and you may choose to allow these sponsors or exhibitors to scan your Credentials so they can contact you with more information.  All scanning is optional. By allowing a sponsor or exhibitor to scan your badge, you authorize VidCon to share with such sponsor or exhibitor the following registration information: first name, email, age, gender, city, state.  You can opt out at any time.

Film and Video Consent

Photographs and/or audio/video recordings taken at the Event by VidCon, or by others on behalf of VidCon, may include a Participant’s image, name, voice and/or likeness. By attending and/or participating in the Event, each Participant hereby grants VidCon permission to use the Participant’s photograph, image, likeness, voice and statements for any purpose, including but not limited to commercial purposes, without compensation or credit to the Participant, in any and all media now known or hereafter devised.

Code of Conduct

Event Participants agree to the VidCon Code of Conduct. VidCon reserves the right, without refund, to revoke the Credentials of Participants whose conduct violates the Code of Conduct.

No Soliciting

Solicitation or selling of items or services is not allowed at the Event unless expressly authorized by VidCon. Any attendee conducting these activities may be removed from the event.

Onsite Security

As a security measure, VidCon may be randomly checking bags onsite for the Event.  No bags or property should be left unattended at any time. Unattended property may be removed.

VidCon reserves the right to take any security measures it deems appropriate to increase the safety of attendees, sponsors, and exhibitors, without prior notice. VidCon reserves the right to change the policies set forth herein, without prior notice, and has sole discretion to deny entry to anyone.

Assumption of Risk

Each Participant understands that participating in the Event is voluntary and may involve certain risks of physical injury, damage to property, and other damages or losses that may be sustained by a Participant. Each Participant assumes all risk of damages, property loss, and personal injury which may occur by participating in the Event.

Australian Consumer Law

Under the Australian Consumer Law (“ACL”), Participants may have certain rights which cannot be excluded, including guarantees as to the acceptable quality and fitness for purpose of goods and services.  Nothing in these Terms is to be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the ACL) and which by law cannot be excluded, restricted or modified.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW: IN NO EVENT SHALL VIDCON BE LIABLE TO ANY PARTICIPANT, AND/OR ANY OTHER PERSON OR ENTITY FOR ANY PERSONAL INJURY OR OTHER DAMAGE TO PROPERTY, DAMAGE FOR LOSS OF BUSINESS PROFITS OR ANY OTHER PECUNIARY LOSS, INCLUDING WITHOUT LIMITATION ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES, ARISING OUT OF ANY PARTICIPANT’S REGISTRATION, USE OF THE CREDENTIALS, AND/OR PARTICIPATION IN THE EVENT, EVEN IF VIDCON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

DISCLAIMER OF WARRANTIES

EXCEPT AS MAY BE EXPRESSLY SET FORTH IN THESE TERMS AND EXCEPT FOR ANY WARRANTIES OR GUARANTEES UNDER THE AUSTRALIAN CONSUMER LAW WHICH CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED BY AGREEMENT, PARTICIPANT’S PARTICIPATION IN THE EVENT, AND ALL SERVICES AND PRODUCTS PROVIDED IN CONNECTION WITH THE EVENT, ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, AND NO OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, ARE MADE WITH RESPECT TO THE SAME, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR SAFETY, OR ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING.

Indemnity

Each Participant agrees to indemnify, defend, and hold harmless VidCon and its subsidiaries, affiliates, officers, directors, shareholders, attorneys, employees, licensors, contractors, advisors, suppliers, agents and other representatives from and against any and all claims, demands and all other liabilities, including without limitation costs and attorneys’ fees, made by any third party arising out of or in connection with each Participant’s registration(s), use of the Credentials, or any Participant’s violation of the Terms; except, in each case, to the extent arising from fraud, negligence or willful misconduct of VidCon or its directors or officers.

Use of VidCon Credentials

VidCon Credentials may not be used as a prize in any form of promotion, contest, game, or sweepstakes without written pre-approval from VidCon.

Lost and Found

Lost and Found will be located at the Information Desk during the Event. Participants can drop off found items at the Information Desk during the Event. Participants can also email a description of an item and the location it was lost or found to australiainfo@vidcon.com. After ninety (90) days following the Event, unclaimed lost and found items may be disposed of in VidCon’s sole discretion.

Governing Law

These Terms of Use and any dispute will be construed in accordance with, and governed by, the laws of Victoria.  Except for small claims actions in Consumer cases, any dispute that is not subject to arbitration shall be decided exclusively by court of competent jurisdiction in Sydney, New South Wales, and you hereby consent to, and waive all defenses of lack of jurisdiction and forum non conveniens with respect to venue and jurisdiction in the courts of Sydney, New South Wales.

Changes to these Terms

By providing reasonable notice to you, we may amend the Terms at any time.  We may provide such notice by posting the relevant revised terms on the VidCon Australia site. If the revised Terms include any material change to your existing rights and obligations, we will notify you as required by law. The revised version will be effective as of the time it is posted, but will not apply retrospectively. Any dispute between you and VidCon that arose before the changes will be governed by the Terms of Use in place when the dispute arose.

General

Entire Agreement.  The Terms, Terms of Use, Privacy Policy, and the other guidelines, policies, licenses, disclaimers posted on the VidCon Australia site, and any other negotiated agreements between you and VidCon constitute the entire agreement between VidCon and you.

Third Party Beneficiaries.  You and VidCon agree there are no third party beneficiaries intended under these Terms of Use.

Severability.  In the event that any term or provision of the Terms shall be deemed invalid, illegal or unenforceable in any respect, such term or provision shall be deemed severable and shall not affect the validity and enforceability of any remaining term or provision.

Waiver.  Any failure by VidCon to enforce or exercise any provision of the Terms or related right shall not constitute a waiver of that right or provision.

Section Titles.  The section titles used in the Terms are purely for convenience and carry with them no legal or contractual effect.

Assignment.  These Terms, and any rights and licenses granted to you by these Terms, may not be transferred or assigned by you, and any such attempted transfer or assignment by you will be null and void.
